Have You or Your Teen Become Addicted to Vaping? Do You have a Claim for an Injury or Illness Caused by a JUUL Vaping Product? Our Attorneys Can Help You Seek Just Compensation.
For a while, JUUL seemed poised to disrupt the vaping industry. Its aggressive marketing campaigns promoted pods and other products that were safe for consumers, and investors poured hundreds of millions of dollars into the company, hoping that it would be the next big thing.
But, instead, JUUL is now facing a different kind of disruption entirely.
Today, JUUL is facing lawsuits across the country. This includes lawsuits filed by users and parents of teens who have been harmed by the company’s dangerous products, as well as lawsuits filed by state Attorney General’s Offices and even the company’s own former employees. These lawsuits involve multiple allegations of wrongdoing, including intentionally targeting underage teens and failing to disclose known risks associated with the use of its products.
Do You Have a Lawsuit Against JUUL?
JUUL, like other companies in the industry, has advertised vaping as a safe alternative to smoking cigarettes. While these claims were based largely on the fact that vaping pods do not contain the same harmful substances as cigarettes, as we now know, these claims were not founded in science. As summarized by Johns Hopkins Medicine:
“[V]aping coats [the] lungs with potentially harmful chemicals. E-liquid concoctions usually include some mix of flavorings, aromatic additives and nicotine or THC (the chemical in marijuana that causes psychological effects), dissolved in an oily liquid base. ‘We think that some of the vaporized elements of the oil are getting deep down into the lungs and causing an inflammatory response,’ explains [Dr. Stephen] Broderick.”
In fact, there are now a number of known risks associated with vaping, and with the use of JUUL products in particular. Some of these risks include:
- Bronchiolitis obliterans (also known as “popcorn lung”)
- Burns resulting from JUUL device fires and explosions
- Hemorrhagic stroke
- Lipoid pneumonia
- Nicotine addiction
- Primary spontaneous pneumothorax (a collapsed lung)
- Respiratory failure
- Seizures and strokes
- Vaping lung disease
According to Johns Hopkins Medicine, cancer is a potential concern as well. “Cancer is definitely a concern, given that vaping introduces a host of chemicals into the lungs. But vaping products haven’t been around long enough for us to learn whether or not they cause cancer. . . . [S]moking tobacco forces tiny particles to be deposited deep in the bronchial tree and can lead to the development of cancer. The same may be true for vaping . . . .”
Signs and Symptoms of Negative Effects from JUUL Vaping Products
For individuals who vape, and for parents of teens who use JUUL products, it is important to be aware of the signs and symptoms of the negative effects of vaping. If you or your teen has experienced any of the following after vaping with a JUUL product, you should seek medical attention promptly, and you should speak with an attorney about filing a lawsuit against JUUL.
1. Signs and Symptoms of Lung Damage and Other Illnesses and Injuries
Bronchiolitis obliterans, lipoid pneumonia, vaping lung disease, and other illnesses and internal injuries caused by vaping can cause symptoms such as:
- Abdominal pain
- Chest pain
- Chronic coughing
- Coughing up blood
- Nausea and vomiting
- Nose bleeds
- Shortness of breath
This list is not exhaustive, and different illnesses and injuries will cause different symptoms. If you have any concerns about possible negative effects from vaping with JUUL products, we strongly encourage you to see a doctor right away.
2. Signs and Symptoms of Nicotine Addiction
Nicotine addiction is a major concern for those who vape—despite the fact that this risk was downplayed by JUUL and other companies in the vaping industry. Tragically, since JUUL marketed many of its products to a younger audience by infusing its pods with sweet flavors and adopting the advertising techniques that the cigarette companies used in the 1980s and early 1990s, a significant number of victims who have developed nicotine addictions as a result of vaping are teens and young adults who are now at risk for suffering life-long effects.
The effects of nicotine addiction can be both physical and psychological. Some of the most-common signs and symptoms of nicotine addiction include:
- Heart palpitations
- Difficulty breathing
- Nausea and vomiting
- Feeling tense
- Feeling tightness in the chest
- Symptoms of nicotine withdrawal
- Difficulty concentrating
- Difficulty sleeping
- Social isolation
Claims Against JUUL in Vaping Lawsuits
Currently, JUUL is facing numerous different types of allegations in lawsuits filed by customers, parents, and others. At Oberheiden Law, our attorneys are available to represent individuals and families in all types of claims against JUUL, and we are currently accepting cases nationwide. Some examples of possible claims against JUUL in vaping lawsuits include:
Deceptive Advertising Targeting Teens
Much of the uproar over JUUL’s marketing practices has focused on the company’s efforts to promote its products to teens. For example, in announcing a lawsuit against JUUL in early September 2020, Washington’s Attorney General stated:
“JUUL put profits before people. . . . Pushing unfair and deceptive marketing strategies appealing to youth, the company fueled a staggering rise in vaping among teens. JUUL’s conduct reversed decades of progress fighting nicotine addiction, and they must be held accountable.”
JUUL’s efforts to target teen users have included, “flood[ing] social media with colorful ads of young-looking models and push[ing] fruit and dessert flavored products.” While JUUL has denied these allegations, they seem difficult to refute, and many families are moving forward with advertising-based claims against JUUL.
False and Misleading Safety Claims
JUUL is also facing lawsuits for making false and misleading claims about the safety of its products. This includes falsely claiming that vaping is safer than smoking cigarettes, and that vaping does not carry the risks of nicotine addiction and lung damage that have been linked to inhaling tobacco smoke.
The reality is that when JUUL made these claims, it did not know if they were accurate at the time. This is because, at the time, no one knew if vaping was truly safer than smoking tobacco. However, as the true risks of vaping continue to become more well-known with more and more patients being diagnosed with vaping-related illnesses and injuries, it is becoming increasingly clear that vaping is not the safe alternative that JUUL represented it to be.
Knowingly Selling Dangerous and Highly-Addictive Products
In fact, at this point there is evidence to suggest that JUUL knowingly sold dangerous and highly-addictive products to its customers. Not only that, but JUUL knowingly marketing these products to teens and young adults. This is an extremely serious issue, and it is one for which the company deserves to be held accountable.
Even as the federal government and state Attorney General’s Offices pushed for bans of JUUL’s products due to the safety risks they presented, JUUL continued its aggressive advertising efforts. While JUUL eventually pulled some of its sweet flavors from its online store, it kept selling other products despite being well aware of the safety concerns they presented.
Defective Vaping Devices
Another issue that has plagued JUUL in the courts is the concern that its e-cigarettes are prone to catching on fire, and even exploding. There have been numerous reports of JUUL e-cigarettes overheating and exploding, in some cases with fatal consequences. Even if a JUUL e-cigarette explosion is not fatal, it has the potential to cause severe physical and psychological trauma, and many individuals have suffered disfiguring injuries that they will carry with them for the rest of their lives.
